These Terms & Conditions ("Terms") govern your access to and use of ovrtechnology.com (the "Site"), and any products, software, mods, or services offered by OVR Technology, Inc. ("OVR," "we," "us," or "our"), including the Omara Scent Display and Scentware® cartridges (collectively, the "Products"). By accessing the Site or purchasing our Products, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on this Site. If you are under 18, you may use the Site only with the involvement and consent of a parent or guardian.

2. Pre-Orders, Orders & Payment

- Products listed as available for pre-order are expected to ship in **2026**. Estimated ship dates are subject to change, and we will make reasonable efforts to keep customers informed of any material delays.

- Risk of loss and title for Products pass to you upon our delivery to the shipping carrier, unless otherwise required by applicable law.
- Additional customs, duties, or import taxes for international orders are the responsibility of the customer.

4. Returns, Refunds & Cancellations

- You agree to use our Products, mods, and software only for lawful purposes and in accordance with any accompanying documentation and the Health & Safety information provided with your device.
- We may update, modify, or discontinue certain software features, mods, or services at our discretion, with notice where reasonably practicable.

6. Intellectual Property

All content on the Site and in connection with the Products — including but not limited to the OVR name and logo, "Omara," "AOS®" (Architecture of Scent), "Scentware®," product designs, graphics, text, and software — is the property of OVR Technology or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content or trademarks without our prior written consent, except as permitted for personal, non-commercial use of the Products as intended.

7. Developer & Build Program

If you access our "Build with AOS®" developer resources or tools, your use of those resources is subject to any additional developer terms or licenses provided at the time of access. Unauthorized commercial use of AOS® technology or Scentware® formulations without a licensing agreement with OVR is prohibited.

8. Third-Party Links & Community

The Site links to third-party platforms, including Discord, Instagram, LinkedIn, YouTube, and TikTok. We do not control and are not responsible for the content, policies, or practices of these third-party platforms. Your participation in our Discord community is also subject to Discord's own terms and any community guidelines we publish there.

9. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN ANY LIMITED WARRANTY ACCOMPANYING YOUR PRODUCT. Please review the Health & Safety page for important information about proper use of the Omara Scent Display and Scentware® cartridges.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVR TECHNOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
