OVR Technology - Limited Warranty

1. What This Limited Warranty Covers

OVR Tech, Inc. (“OVR”) warrants OVR-branded products against defects in materials and workmanship under normal use during the applicable warranty period described below. This Limited Warranty is separate from the OVR Shipping and Returns Policy. A return addresses return and refund eligibility; a warranty claim addresses a product defect through repair, replacement, or another remedy required by applicable law.

1.1 Who provides this warranty

This Limited Warranty is provided by OVR Tech, Inc. OVR administers all warranty claims directly. OVR does not currently use a third-party warranty administrator or service network. If that changes, OVR will update this Limited Warranty and continue to honor claims for products already sold.

1.2 Who is covered

This Limited Warranty extends only to the original end-user purchaser who bought the product new from OVR or from an OVR-authorized channel, and only for the original purchase transaction. It is not transferable.

This Limited Warranty does not extend to a subsequent owner, to a person who receives the product through resale, or to a product purchased from a seller that is not authorized by OVR. A product received as a gift is covered for the recipient, provided the gift was purchased new from OVR or an OVR-authorized channel and proof of the original purchase is available.

1.3 Where this warranty applies

This Limited Warranty applies to products purchased and delivered in the United States, including U.S. territories and APO/FPO/DPO addresses, and warranty service is provided in the United States only. OVR does not currently offer international warranty service and cannot ship warranty repairs or replacements to addresses outside the United States.

If OVR accepts an order for delivery outside the United States on an individual basis, OVR will state in writing before that order is placed what warranty support, if any, is available for it. Nothing in this Section limits non-waivable statutory rights that may apply to you under the law of your country or region.

2. Warranty Periods

A replacement product or component is covered for the longer of the remainder of the original warranty period or any minimum period required by applicable law.

3. Scentware Warranty

Scentware may be final sale under the OVR Shipping and Returns Policy, but it remains covered by this Limited Warranty. If Scentware arrives damaged, leaks, fails to release scent as intended, or stops functioning correctly because of a covered defect within sixty (60) days after delivery, contact OVR for warranty support.

Normal depletion, diffusion, evaporation, fading, or change in scent intensity through ordinary use, opening, or passage of time is not a defect and is not covered unless the product fails to conform to OVR’s stated specifications for reasons unrelated to normal depletion or storage conditions.

4. What Is Not Covered

This Limited Warranty does not cover:

• Normal wear and tear or cosmetic changes that do not affect normal function.

• Accidental damage, abuse, misuse, neglect, improper storage, improper cleaning, liquid exposure, extreme temperatures, or use contrary to OVR instructions.

• Normal depletion or aging of scent material through use or exposure to air.

• Damage or malfunction caused by unauthorized modification, repair, disassembly, firmware modification, or use of incompatible or unauthorized Scentware, accessories, chargers, cables, or software.

• Damage caused by third-party products or content rather than a defect in the OVR product itself.

• Loss, theft, or damage caused after delivery by shipping or handling not arranged by OVR, except where applicable law provides otherwise.

• Use of a third-party or unauthorized product does not automatically void this Limited Warranty. OVR may deny coverage only for damage or malfunction that falls within an exclusion above or as otherwise permitted by applicable law.

5. Warranty Remedies

For a valid covered claim, OVR may, at its option and subject to applicable law:

• Repair the covered product or component;

• Replace it with a new or functionally equivalent new or refurbished product or component; or

• Provide another remedy, including a refund, where required by applicable law or where OVR determines repair or replacement is not reasonably available.

OVR will provide claim-specific instructions, including whether the product must be returned and how to package or ship it. Do not ship leaking, swollen, damaged-battery, or otherwise hazardous products until OVR provides appropriate instructions.

5.1 Shipping costs for warranty claims

For a valid claim covered by this Limited Warranty, OVR pays shipping in both directions within the United States. OVR will provide a prepaid return shipping label for sending the product to OVR, and OVR pays the cost of shipping the repaired or replacement product back to a U.S. address, using a carrier and service level that OVR selects. Ship the product back within fourteen (14) days after you receive the label.

If OVR determines after inspection that the product is not covered by this Limited Warranty, OVR will tell you before taking further action and will explain why. You may then choose to have the product returned to you at your expense, to obtain a repair estimate where one is available, or to have OVR responsibly dispose of or recycle the product. If you do not respond within thirty (30) days of that notice, OVR may return the product to you at your expense or hold it pending your instructions.

If your product contains a rechargeable lithium battery, your shipment may require an additional battery handling label. Attach it exactly as instructed, because carriers require it and packages without it can be delayed or rejected.

Expedited shipping, shipping to or from an address outside the United States, and shipping costs for a claim that is not covered are your responsibility, except where applicable law provides otherwise.

6. How to Make a Claim

Contact OVR at support@ovrtechnology.com and provide reasonable information needed to evaluate the claim, which may include proof of purchase or delivery, order number, product serial number or Device identifier, photographs, a description of the problem, troubleshooting results, and contact information.

OVR may require reasonable troubleshooting or inspection before approving a warranty remedy. Do not disassemble or attempt an internal repair unless OVR specifically instructs you to do so.

7. Consumer Law and Regional Rights

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. IT DOES NOT REPLACE OR LIMIT NON-WAIVABLE RIGHTS YOU MAY HAVE UNDER APPLICABLE CONSUMER LAW.

7.1 Implied warranties

TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE APPLICABLE WARRANTY PERIOD STATED IN SECTION 2, WHICH IS TWO (2) YEARS FROM DELIVERY FOR HARDWARE AND OVR-BRANDED ACCESSORIES AND SIXTY (60) DAYS FROM DELIVERY FOR SCENTWARE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

7.2 Incidental and consequential damages

TO THE EXTENT PERMITTED BY APPLICABLE LAW, OVR IS NOT LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF A DEFECT IN OR THE USE OF AN OVR PRODUCT, INCLUDING LOSS OF USE, LOST TIME, INCONVENIENCE, OR COMMERCIAL LOSS. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. NOTHING IN THIS LIMITED WARRANTY EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FOR FRAUD, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

The repair, replacement, or refund remedies described in Section 5 are your exclusive remedies under this Limited Warranty, except where applicable law provides otherwise.

7.3 Regional rights

In some jurisdictions, including the EEA and UK, consumers may have statutory rights against the seller for goods that are faulty, do not conform to the contract, or fail to meet mandatory quality requirements. Those rights may apply for periods or provide remedies that differ from this Limited Warranty. Where a statutory right provides greater protection, the statutory right controls.

8. Relationship to Returns and Safety Instructions

Return eligibility and refunds for non-defective products are governed by the OVR Shipping and Returns Policy at http://ovrtechnology.com/shipping-returns. Safe use, storage, cleaning, charging, and handling instructions are described in the OVR Health and Safety Disclosure at http://ovrtechnology.com/healthandsafety and the product manual.

9. Dispute Resolution

Disputes relating to this Limited Warranty are subject to the informal resolution, binding individual arbitration, class action waiver, and venue provisions in Section 22 of the OVR Terms of Service, including your right to opt out of arbitration within thirty (30) days of accepting those Terms. Before starting a formal proceeding, contact OVR so that OVR has an opportunity to evaluate and resolve the claim.

Nothing in this Section or in Section 22 of the Terms of Service limits non-waivable statutory consumer rights, and either party may bring an individual claim in small claims court.
